If you have been told that there are such things as simple Separation and Property Settlement Agreements, then you have been misled. I ask you, was your marriage simple? Well if you believe untangling the legal consequences of a marriage are simple, think again.
Separation and Property Settlement Agreements can and often do address many complex issues such as child custody, property distribution, debts, retirement accounts, business assets, alimony, and indemnification issues. Other important considerations are the ages of the parties as well as the manner and expectation in which the agreement will be enforced. Will it become part of your divorce judgment? In short, you need to spend time with your family law attorney. If that attorney says, “oh you need a simple agreement”, I suggest you might want to shop around for a different attorney.
