CAN I MAKE HIM/HER PAY MY EQUITABLE DISTRIBUTION CLAIM?

No.................the North Carolina Statute concerning Equitable Distribution does not allow the prevailing party to "tax" the other party for their attorney's fees and costs. However, if the other party fails to comply with the Equitable Distribution Order and you have to take them back to court, then yes, you have the right to ask for attorneys fees and costs. The Court will most likely award attorney's fees and costs when required to enforce a previously issued Equitable Distribution Order.
